Welcome to 'BrowseAura' ('we', 'us', or 'our'). By accessing or using our website and/or engaging our services, you agree to be bound by the following Terms of Service. These terms govern all service interactions and business engagements between you ('client', 'you', or 'your') and 'BrowseAura'. We offer web development and design services tailored primarily for small businesses. Our services include:

Monthly plans include hosting, maintenance, continued updates, and on-going support. One-time plans (no monthly fee) include only the codebase delivery and setup as agreed. Any additional requests beyond the above standard offerings are considered outside our standard scope of work and may incur extra charges. These may include, but are not limited to: social media, third-party integration, large content revisions, copywriting, or new feature development.

Handoff & Client Responsibilities

When a client chooses a one-time plan (no monthly fee), we design and develop the website and provide the final deliverables. After this, the responsibility for hosting, maintenance, and security lies entirely with the client.

We do not guarantee error-free or bug-free performance of any website or service. While we strive for quality and reliability, we make no warranties, expressed or implied, including but not limited to the warranties of merchantability and fitness for a particular purpose.

Hosting and Uptime

For clients on monthly plans, we manage hosting and web infrastructure to ensure optimal performance, uptime, and security. While we strive to minimize downtime, some interruptions may occur due to:

We aim for 99.9% uptime but cannot be held responsible for third-party outages. We use Cloudflare to manage SSL/TLS encryption for secure data transmission. SSL certificates are generated via Cloudflare and may be uploaded to the hosting server as part of the deployment process. While we facilitate SSL setup, ongoing certificate renewal or issues related to third-party SSL services fall outside our direct control unless otherwise agreed upon.

Payment and Billing

Clients are billed based on their selected package, or otherwise negotiated. Monthly plans include ongoing service delivery as outlined. Payments are due as per the agreement and/or any contract proposed by us. Failure to pay may result in suspension or termination of service. All fees are non-refundable once services have been rendered, including design, development, or hosting time already committed. Clients may cancel anytime — but all work is done under a clear mutual agreement, or contract to protect both parties.

Before your website is built and ready to launch, we require an initial setup deposit fee of 30% of your total project price. For example, if your total price is $100, a $30 deposit is due before development begins, and the remaining $70 is due once your site is ready to launch. If you've opted-in for continued expert maintenance, management, etc. from us, we charge a monthly fee. This helps cover setup, licensing, and configuration costs.

If you're not satisfied at launch, we'll continue working with you within a reasonable scope of revisions until you're satisfied, at no extra cost — or provide a refund if an agreement cannot be reached. Excessive or unreasonable revision requests beyond the agreed scope may incur additional charges. Payment is required once the website is complete and ready for delivery. We allow flexibility in payment terms, and they can be discussed and agreed upon before the project begins. However, no project handoff — including code, credentials, or live deployment — will be made until the remaining or full payment of your project price has been received. All prices are shown and discussed in Canadian Dollars (CAD).

Scope Limitations

Anything outside of standard development, design, hosting, SEO, or minor updates is considered outside the standard scope and will require additional billing. This includes but is not limited to:

Intellectual Property

All code, design assets, and original content created by us remain our intellectual property until full payment is received. After full payment, ownership transfers to the client except for any third-party tools, libraries, or assets licensed separately, which are governed by their own terms. We reserve the right to display completed work in our portfolio unless explicitly requested otherwise by the client.

Client Data & Privacy

We do not sell or share client data. Any information provided to us during a project is used solely to deliver and improve our services. Clients are responsible for the legality and compliance of all content provided (e.g., images, text, videos).

Liability & Disclaimer

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. We are not liable for performance issues caused by user modifications, third-party software, or external attacks.

Termination

Either party may terminate the service with written notice. Any services rendered up to that point must be paid for. Upon termination of a monthly plan, hosting and maintenance will be discontinued unless otherwise arranged.

Modifications

We reserve the right to update or modify these Terms of Service at any time. Changes will be posted on our website. Continued use of our services after such changes constitutes your acceptance of the new terms.
